THE NEW YORK TIMES SUES MICROSOFT AND OPENAI FOR IP INFRINGEMENT

The New York Times has filed a lawsuit against OpenAI and Microsoft on the grounds that the copyrighted content used in the artificial intelligence tools developed by these two companies is protected by intellectual property rights. The lawsuit filed by The New York Times alleges the unauthorised use of copyrighted content created by The New York Times used to train the systems used in ChatGPT and other similar generative artificial intelligence models and advanced language models developed by Microsoft and OpenAI. In the lawsuit, which is filed in Manhattan federal court at the very end of 2023, It is suggested that the amount to be decided and the total damage that may occur may reach billions of dollars.

AUSTRALIAN DPO HAS LAUNCHED AN INVESTIGATION INTO TIKTOK

The Office of the Australian Information Commissioner has launched an investigation into Tiktok, a social media platform in Australia, to investigate how TikTok collects personal data through its application and whether this is done lawfully with the consent of data subjects. One of the main activities that led to the launch of the investigation is to determine whether Tiktok has breached its obligations regarding the processing of personal data by using the systems to identify the online habits of its users for marketing purposes. In this context, it will be determined whether marketing activities are carried out through pixels on the platform. It is envisaged that the personal data in question may include personal information such as where users shop, how long they spend on websites and their email addresses and mobile phone numbers.

GOOGLE AGREES TO A SETTLEMENT IN A CASE AGAINST ALPHABET

Alphabet, the umbrella company of Google, has been sued for tracking and collecting users' data through the Google Chrome browser, even when users are using the Incognito mode. In a statement issued by the company, it was announced that a resolution had been reached in the lawsuit, which accused Google of improperly processing the personal data of Chrome browser users, even in incognito mode, and demanded a total of $5 billion in compensation. While the settlement text does not specify the amount of compensation, Google stated that the parties will finalise the settlement text by submitting it to the judge for approval no later than 24 February 2024.

INVESTIGATION FOR TWITTER REGARDING EU’S DIGITAL SERVICES ACT

The European Commission has announced that it has started an investigation into Elon Musk's social media platform X, formerly known as Twitter, for alleged violations of the European Union's Digital Services Act. The decision to investigate was taken after X failed to provide documents requested in October on how the platform eliminates hate speech, discrimination, and fake news. Under the Digital Services Act, which came into force in the European Union in August 2023, any company found to be in breach of the law could be fined up to 6% of its global turnover and its activities in the European Union could be suspended. The statement made by X says that the compliance processes regarding the European Union Directives will be conducted quickly and decisively.

AGREEMENT ON DRAFT EU REGULATION ON ARTIFICIAL INTELLIGENCE

A preliminary agreement has been reached between the European Union member states and the European Parliament on the Artificial Intelligence Regulation that will come into force in the EU. It is stated that the political agreement is a significant development in terms of the EU taking the lead on artificial intelligence. In this context, the discussions covered disputes that may arise from the activities of chatbots, biometric recognition systems, ensuring general security, the use of emotion recognition and similar biometric systems. Following the discussions, the draft text will be submitted to the European Parliament for approval. The final decision on the draft is expected to be taken by the European Parliament in the beginning months of 2024.
